Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or terrorist offences related to a terrorist act or terrorist activity. Where applicable, the bidder must also confirm that it has taken self-cleaning measures to restore reliability. The machine-readable notice stated the exclusion grounds only in general terms; the exact details must be checked in the tender documents.
Qualification criteria and exclusion grounds
To perform the framework agreement, the bidder must hold a permit issued by the Agricultural and Food Board for handling food products in its field of activity. This requirement applies to lots 1–10: dairy products, bread and bakery products, dry goods/preserves/canned goods, juices, fruit and vegetables, frozen products, pork products, beef products, poultry products and organic products. The contracting authority will verify the existence of the permit itself. When submitting the tender, the bidder must confirm that the tender complies with the conditions set out in the procurement documents, and the required tender price form must be submitted for the lot. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
