Summary

The tender concerns the purchase of heat energy for Kilingi-Nõmme Gymnasium, Tihemetsa Leisure and Sports Centre, and the Saarde municipal office building. In addition, maintenance and repair of the assets needed for heat energy production are included. Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, nor other persons with authority to represent it, have been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences or other offences related to terrorist activity, money laundering, illegal employment of foreign nationals without legal basis, child labour, human trafficking, or any other exclusion grounds listed in the ESPD. The bidder must also confirm that it has no tax debt and is not subject to international sanctions. If an exclusion ground applies, the bidder may submit evidence of self-cleaning where permitted.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of its country of establishment, and the contracting authority may require proof of registration. The bidder must have a turnover of at least EUR 200,000 in the required financial year(s). For technical and professional capacity, the bidder must have properly performed, during the 36 months before the start of the procurement, direct production and sale of heat energy similar to the subject of the contract for at least three institutions, with at least 900 MWh per year for each institution. The contracting authority also accepts as similar the sale of fuel needed for heat production together with heat production, including maintenance of heat production systems. The bidder must submit the list of completed contracts on Form 2. The bidder must have a valid activity licence or equivalent registration for fuel sales, specifically wholesale of other liquid and gaseous fuels and similar products, or an equivalent authorisation in the country of establishment. If relying on a subcontractor for the licence, the bidder must submit a subcontractor ESPD signed by an authorised representative of that entity. The bidder must include a pressure equipment direct user and a supervisor of use who meet the competence requirements set out in the relevant ministerial regulation, and must provide a copy of the supervisor’s competence certificate. For an employee, proof of registration must be provided; for another person, a civil-law agreement for the specialist’s use must be submitted.
