Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurists or other persons with authority to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The tender documents also require a confirmation that the offered goods are not subject to international sanctions and do not originate from a sanctioned area.

Qualification criteria and exclusion grounds

The bidder’s team must include two maintenance engineers or technicians who have received manufacturer training for servicing and repairing the device. The bid must include the names of these maintenance technicians and the manufacturer-issued training certificates. The bidder must be the official representative of the offered device and must submit a document proving representation rights granted by the manufacturer or, if applicable, by the manufacturer’s authorised representative; in case of sub-delegation, the relevant sub-delegation documents must also be provided. The offered device must bear the CE marking and comply with Regulation (EU) 2017/745; a declaration of conformity and, where applicable, a conformity certificate or copies must be submitted. The bid must comply with the technical requirements and be submitted according to Annex 1. In the case of a joint bid, a power of attorney for the joint bidders and a confirmation of joint and several liability must be provided. The bid must also include the application for participation in the procurement and a confirmation that the bid complies with the procurement documents and that the bid price is presented in the required structure.
