Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions of the bidder or its management/representation bodies for organised crime, corruption, fraud, terrorist offences, money laundering or terrorism financing; no convictions for illegal employment of foreigners or breach of foreign workers’ conditions; no convictions for illegal use of child labour or human trafficking; no tax, environmental or social security debts; and no sanctions conflict that would prevent the contract from being awarded. The bidder must also confirm that none of the optional exclusion grounds apply, including serious or repeated breach of previous public contracts or false statements or failure to submit required documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 400,000. The bidder must submit extracts from the reports of the last three completed financial years showing the net turnover, unless the data are publicly available to the contracting authority from a register for an Estonian legal entity. If the bidder’s financial year does not match the calendar year, the turnover requirement applies to the last three completed financial years. At least six months must have passed since the end of the latest completed financial year by the bid submission date. The bid must also include the required price form, technical information form, authorised signatory and contact person details, and confirmation that the bid meets the tender documents. If representation rights do not arise from the articles of association, a power of attorney must be included. The bidder must confirm acceptance of the contracting authority’s standard payment term unless it has joined the factoring programme. The bidder must state any trade secret information and justify it. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or Belarus, and that the offered goods and their components are not produced in or originating from Russia or Belarus; the contracting authority may request a certificate of origin.
