Compliance requirements
The bidder must confirm that neither the bidder nor members of its management, administrative or supervisory bodies, nor persons with authority to represent it, make decisions on its behalf or control it, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, a terrorist offence or any other exclusion ground named in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority may also reject the bid if sanctions requirements are breached.
Qualification criteria and exclusion grounds
The bidder must have performed at least two contracts for the sale of the products offered in the tender during the last three years. A list of those contracts must be submitted, including the subject matter, value, signing dates and the other contracting party. The bidder must have the right to represent and sell the offered products in Estonia and must provide a document, or copy, issued by the manufacturer or the manufacturer’s authorised representative; in case of sub-delegation, the relevant additional documents must also be provided. The offered products must comply with the technical descriptions in Annex 1. The bid price must be submitted according to Annex 2 with unit prices and total price, and must include the product name, manufacturer, product code or reference number, and actual parameters. The participation application in Annex 3, Form II, must also be submitted, and if applicable, the joint bidders’ power of attorney and confirmation of joint and several liability.
