Compliance requirements
The contracting authority will exclude a bidder if any of the statutory exclusion grounds apply, including criminal convictions of the bidder or its representatives, illegal employment of foreigners, child labour or trafficking, tax or social security debt, or a sanctions conflict. The notice also mentions possible exclusion for breaches of environmental, social or labour obligations, bankruptcy or liquidation, serious professional misconduct, local tax debt, anti-competitive conduct, conflicts of interest, serious breach of previous contracts, false information, attempts to influence the authority, tax offences, or lack of the right to submit a tender. If the bidder relies on another undertaking’s resources, it must also provide the required declaration for that undertaking.
Qualification criteria and exclusion grounds
The bidder must have, during the period from 01.01.2023 until the publication date of the contract notice, either delivered cleaning attendant training within formal education or delivered cleaning attendant group training totalling at least 300 contact teaching hours. The bidder must submit the prescribed qualification data form and indicate whether it relies on another entity’s resources to meet the qualification requirement. The bidder must also confirm that it has not materially breached administrative contracts concluded with it and that there are no circumstances that could lead to its persistent insolvency or cessation of business. If the bidder relies on another undertaking’s resources, the required declaration on the absence of exclusion grounds must also be provided for that undertaking.
