Compliance requirements

The bidder must confirm that no exclusion grounds apply. The notice lists the usual mandatory exclusion grounds, including convictions for corruption, fraud, terrorist offences, money laundering or financing terrorism; illegal employment of foreign nationals; child labour or human trafficking; tax, social security or environmental charges arrears; and sanctions-related restrictions. The notice also lists optional exclusion grounds, such as serious breaches of environmental, social or labour obligations, insolvency or liquidation, serious professional misconduct, local tax arrears, anti-competitive agreements, conflicts of interest, prior serious contract breaches, false information, attempts to influence the contracting authority, tax offences, or lack of the right to submit a tender. The bidder must provide the required confirmations in the tender.

Qualification criteria and exclusion grounds

The bidder must submit confirmations that no exclusion grounds apply and that it has not seriously breached contracts with public authorities or is in a situation that could lead to permanent insolvency or cessation of business. In a joint tender, these conditions must be met by all joint bidders. The tender must comply with the procurement documents, and where relevant the bidder must provide explanations and evidence of equivalence. In a joint tender, an authorised representative must be appointed and a power of attorney for the joint bidders must be attached. An Estonia-registered bidder must submit an Estonian language continuing education curriculum for preparation for the B1 level exam, in line with the procurement documents. A bidder registered in a foreign country must submit a copy of the relevant licence or a document proving membership in the relevant organisation, or a link to a public register and the licence number, if such authorisation is required in the country of origin. The training must be delivered at the location specified in Annex 1, point 1, which must be within a 10-minute walk from an official public transport stop. The address(es) of the training venue must be stated in the tender.
