Compliance requirements

The tender documents include the standard exclusion grounds, especially convictions-related grounds such as participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds. The bidder must answer the exclusion questions in the tender documents and, where applicable, may provide evidence of self-cleaning. The machine-readable notice did not provide a complete list of all exclusion grounds in one place, so the official tender documents must be checked for the full wording and any additional grounds.

Qualification criteria and exclusion grounds

The bidder must submit the confirmations and documents required in the ESPD and compliance conditions. The offered medicine must have a valid marketing authorisation in Estonia; if it does not, the tender documents describe an exception and the contracting authority will check the authorisation in the Medicines Agency register. The bidder must hold a valid wholesale distribution licence for medicines in Estonia. The bid must be submitted on Annex 1 in Excel format, and for each offered medicine the bidder must state the active substance name, original name, dosage form, offered strength, manufacturer, unit price and total price. In the case of a joint bid, a power of attorney and a confirmation of joint and several liability must be submitted on Annex 3 form I. If equivalence is relied on, explanations and evidence must be attached. If the bidder relies on the capacities of other entities or uses subcontractors, the relevant details and confirmations must be provided where required for the bid.
