Compliance requirements

The tender documents include mandatory exclusion grounds based on criminal convictions and related self-cleaning possibilities. These cover participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and other standard exclusion grounds set out in the ESPD. If an exclusion ground applies, the bidder may be allowed to provide evidence of self-cleaning where the procurement documents or applicable law permit it. The machine-readable notice did not include the full list of exclusion grounds in plain summary form; the official tender documents must be checked.

Qualification criteria and exclusion grounds

The bidder must provide turnover data in the ESPD for the last two completed financial years before the start of the relevant procurement procedure. The total annual turnover for the last three completed financial years before the start of the procurement procedure must be at least EUR 100,000. If turnover data are not available in a public database, the contracting authority may require annual reports or extracts for the last three completed financial years. The bid must comply with the tender documents and conditional bids are not allowed. If the bidder also offers the student card service, it must submit a description of that service, including the processes for activation, user identification, management of usage rights, deactivation and reactivation, as well as an explanation of which personal data are processed and how data security is ensured. Together with the bid, the bidder must also submit an initial description of service takeover showing how service launch, data transfer, interface setup, compatibility checks for existing cards and devices, and school guidance will be handled. If the bid is a joint bid, a power of attorney from the joint bidders must be included. The bidder must also confirm compliance with the tender documents, provide any required equivalence explanations and supporting evidence, and submit the bid price in the required structure. If the offered item or service relies on a standard, technical specification, trademark or other equivalence basis, equivalent evidence must be provided where required.
