Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(3) and (5) of the Estonian Public Procurement Act apply, taking into account subsection 2 where relevant. The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been initiated against it, that its business has not been suspended, and that it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax debt, environmental charge debt, or social security contribution debt under the law of its country of establishment. The bidder must also confirm that its employees’ average salary during the reference period was more than 70% of the average salary in the same period in the relevant field, and this must be evidenced by a Tax and Customs Board extract or, for a foreign bidder, by evidence from an equivalent competent authority. The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building.

Qualification criteria and exclusion grounds

The bidder must have submitted a notice in the business register for the activity of construction, covering general construction, indoor climate systems, and building-internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a notice for electrical works covering construction, including installation, of electrical installations. These registration requirements do not apply to a foreign bidder, but it must provide equivalent proof of competence where applicable. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated value of the contract excluding VAT. In addition, the bidder must be able to provide a performance guarantee equal to 5% of the contract value at contract signature or within 10 calendar days after signature; acceptable forms include a bank or financial institution guarantee, deposit of the amount into the contracting authority’s account, or deposit into a notary’s account. Within the last 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the construction, extension, or full-building reconstruction of a building as the main contractor, including at least the construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system. Proof of completion must be provided by the number of the occupancy notice or building permit in the building register, or by a copy of the handover-acceptance certificate signed by the client and contractor. The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a competent person. The project manager must hold at least Level 6 construction engineer qualification with a specialisation in building construction or Level 6 construction manager qualification with a specialisation in general construction. The site manager must hold at least Level 5 construction foreman qualification with a specialisation in general construction works. The ventilation and heating systems specialist must hold at least Level 6 heating, ventilation and cooling engineer qualification or Level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must hold at least Level 6 water supply and sewerage engineer qualification or Level 6 construction manager qualification with a specialisation in the construction of building-internal or building-related water supply and sewerage systems. For electrical works, the involved person must hold at least a Class B competency certificate or Level 6 electrical engineer qualification in consumer electrical installations. The person responsible for compliance with the European New Bauhaus requirements must hold a Level 7 authorised architect qualification. The bidder must provide the name and qualification or competency certificate number for each of these persons.
