Compliance requirements

The contracting authority will exclude a bidder if the mandatory exclusion grounds under Section 95(1) of the Public Procurement Act apply. The same checks are also carried out for any entity whose resources the bidder relies on for proving qualification. The contracting authority may also exclude a bidder if the exclusion ground under Section 95(4)(8) applies, i.e. if there has been a previous breach of public contracts. This check also applies to any supporting entity. If the bidder answers “No” to the exclusion-ground questions, it must describe which exclusion grounds or contract breaches apply, including the relevant contract details and circumstances, within the limits of the form.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last two completed financial years must have been at least EUR 120,000. If the bidder’s financial year follows the calendar year, the last two completed financial years are 2025 and 2024. The bidder must have properly performed at least one similar construction contract within the 60 months preceding the publication date of the contract notice. A similar contract is one in which a new electrical system was built or an existing one was reconstructed. The bidder must involve an electrical works project manager who has at least a Class B competence certificate or at least the professional certificate “Electrical Engineer Level 6” or equivalent. If the specialist’s certificate or other proof of qualification was issued outside Estonia, the bidder must also submit the document issued by the competent body and the document issued by the competent Estonian authority confirming equivalence of the foreign qualification. The bidder must submit Forms 1, 2, 3, 4 and 8 in accordance with the tender documents. If the bid is submitted jointly, a representative of the joint bidders must be appointed and a power of attorney and confirmation of joint and several liability must be submitted. The bid must also include the required price table, a list of documents protected by business secrecy with reasons, where applicable confirmation of protection of restricted information, and, upon the contracting authority’s request, product sheets, specifications or other documents proving compliance. Where the tender documents refer to standards, labels or other references with an “or equivalent” clause, the bidder must provide evidence of equivalence if needed.
