Compliance requirements

The tender documents require the bidder to confirm that none of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The downloaded subcontractor-control document also states that subcontractors used in contract performance must meet the same exclusion-ground requirements as the main contractor, and the contracting authority may check this and request supporting information.

Qualification criteria and exclusion grounds

The bidder must have an MTR registration in the road construction field; the contracting authority checks the registration itself. The average wage of the bidder’s employees or the subcontractor named in the bid must not be below 60% of the average wage in the relevant field for the same period. The reference period is six calendar months, ending with the penultimate calendar month before the start of the procurement. If the bidder or subcontractor was established or started business later, the reference period starts from the month of establishment or business start. A certificate from the Tax and Customs Board or the equivalent foreign authority showing the average wage must be submitted. The bidder must have the machines and equipment needed for grading gravel roads and must submit Form 1, the list of machines and equipment. The bidder must provide details of at least two service contracts completed within the 36 months before the start of the procurement. The details must include the contract value, dates and the other contracting parties. The contracting authority may also take older contracts into account if this helps ensure sufficient competition.
