Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or violating the conditions for employing foreigners in Estonia; offences related to illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the bidder’s country of establishment; and situations where awarding the contract would breach an international sanction or a sanction of the Estonian Government. The bidder must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must have properly performed at least one contract of similar complexity and scope for insulation installation or repair work on piping or production equipment within the 60 months before the start of the procurement. A list of at least one such contract must be submitted, including its value, dates and the other contracting parties. The bidder or its subcontractor must also have a qualified person responsible for the works: a construction manager with professional qualification as a civil engineer at least level 6 (excluding initial qualification) with competence in managing construction activities, or a construction manager at least level 5. A copy of the document proving that person’s qualification and competence must be submitted. In addition, the bidder must provide a description or product sheet of the proposed insulation material, and the bid must comply with the tender documents. Site visit participation is required if the contracting authority has set it as a condition.
