Compliance requirements
The bidder may be excluded if it is bankrupt or in liquidation, if insolvency or liquidation proceedings have been opened, if business activity is suspended, or if it is in a similar situation under the law of its country of establishment. The bidder may also be excluded if it has tax, fee or environmental charge arrears, or arrears of social security contributions, unless the debt has been deferred or paid within 10 calendar days after notice. The bidder must also meet the mandatory confirmations under the Public Procurement Act, including that the exclusion grounds in § 95(1)(1–3 and 5), as applied under § 95(2), do not apply, that the average wage condition is met, and that there is no related-person link with the technical consultant advising the apartment building reconstruction. If the notice does not allow the authority to verify the absence of exclusion grounds from public registers, the bidder must submit the required evidence within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems; for electrical works, the bidder must also have the relevant electrical works registration. Foreign bidders may prove equivalent competence with an equivalent document. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated value of the contract, excluding VAT, and the exact amount must be entered in euros. The bidder must be able to provide a first-demand construction-period guarantee of 5% of the contract value excluding VAT by the contract date, or within 10 calendar days after signing if the contract is signed earlier. The bidder must have completed at least one comparable construction contract in the last 60 months with a value of at least half of the estimated contract value; comparable work means construction of a building, extension, or full-building reconstruction as the main contractor, including load-bearing and external envelope works, heat-recovery ventilation, and a new heating system. The bidder must name the required team members and prove their qualifications: project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, and, if electrical works are performed, a person with at least B-class competence certificate or electrical engineer qualification in consumer electrical installations. The bid must include the required declarations, the joint tender power of attorney if applicable, the price form, and confirmation that the tender complies with the tender documents.
