Compliance requirements
The tender documents include mandatory exclusion grounds. The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor persons authorised to represent, decide for or control the bidder, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and other listed offences. If an exclusion ground applies, the bidder may provide evidence of self-cleaning where allowed. The machine-readable notice did not include the full list in a concise form, so the exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total turnover for the last three completed financial years must be at least EUR 200,000 excluding VAT. To prove this, the contracting authority may request extracts from annual accounts or other evidence; for a legal entity registered in Estonia, this may not be required if the data are publicly available.
For technical and professional capacity, the bidder must have performed at least 2 sales contracts for similar products or equivalent products during the last 36 months. The bidder must provide a description of the contracts, the dates and the value, or confirmations from the contracting parties that the contracts were performed properly.
If the bidder relies on the resources of another company, it must also submit a tenderer profile for that company and that company’s consent to the reliance on its resources.
The bid must include product information on the manufacturer’s form, copies of original documents with an Estonian translation if the document is not in Estonian, and samples of the main materials of the offered products together with the manufacturer’s certificates. The submitted documents must not be older than 3 years. The contracting authority may reject the bid if the required samples or certificates are not submitted by the deadline.
