Compliance requirements
The tender documents include the standard exclusion grounds, especially criminal convictions such as participation in a criminal organisation, corruption, fraud and other mandatory grounds under the Public Procurement Act. If an exclusion ground applies, the bidder may need to show self-cleaning measures. The machine-readable notice did not provide a complete list of all exclusion grounds, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must submit the procurement participation application with completed information (Form I). In the case of joint bidders, a power of attorney under Form II must be submitted. The bid must comply with the tender documents, and if equivalence is relied on, it must be explained and supporting evidence must be attached. The bidder’s place of residence or establishment must be in Estonia, another EU Member State, an EEA Agreement State, or a country that has acceded to the WTO Government Procurement Agreement. By submitting the bid, the bidder must confirm that the award of the contract would not violate an international sanction. The bidder may not involve subcontractors or suppliers for more than 10% of the contract value, nor rely for qualification purposes on Russian citizens, residents, or entities established in the Russian Federation, or on persons connected to them. The offered products must comply with the conditions set out in Form III, the sample shopping basket, and the bid price must be entered according to the structure in the register worksheet titled "Award criteria and evaluated indicators".
