Compliance requirements
The contracting authority excludes tenderers originating from third countries. Third countries are countries that are not EU member states, EEA countries, WTO GPA parties, or countries with which the EU has a reciprocal free trade agreement covering public procurement. The notice also refers to a national legal exclusion ground: a person who is not allowed under the law to submit a tender or request, except in the case provided for in section 111(6). The compliance conditions require a joint tender power of attorney if the bid is submitted jointly, confirmation that the offer complies with the tender documents, submission of the offer price in the required structure, explanation of equivalence and supporting evidence where needed, a trade secret marking and justification, completion of the technical requirements form, confirmation of a warranty period of at least 12 months from acceptance of the works, and acceptance of the payment terms and contractual penalty terms. As optional additional systems, the bidder may offer a verification or automatic defect detection system and an automatic defect removal system, but these only give extra points and are not mandatory.
