Compliance requirements
The contracting authority will exclude a bidder if any exclusion ground under Section 95(1) of the Public Procurement Act applies. If the bid is submitted together with a foreign company, the bidder must submit documents proving the absence of exclusion grounds for that foreign company, including its management and supervisory board members and other persons entitled to represent it. Additional documents must be provided on request if the contracting authority cannot verify the information from public registers. The bidder must also confirm that neither the bidder nor the relevant representatives have been convicted for participation in a criminal organisation, breach of integrity obligations or corrupt acts, fraud, terrorist offences or related offences, money laundering or terrorist financing; for enabling work for an alien staying in the country without a legal basis or violating conditions for employing an alien in Estonia, including paying less than the statutory wage rate; for illegal use of child labour or human trafficking; that the bidder has no tax, fee or social security contribution debt; and that signing the contract would not violate an international or Government of the Republic sanction.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 3,000,000 excluding VAT, with at least EUR 1,000,000 in each year. If the bidder is not a legal entity registered in Estonia, or if the contracting authority cannot verify the information from public sources, the bidder must provide extracts from annual reports or other evidence on request. Joint bidders may rely on each other’s figures. The bidder must have properly performed at least one contract for cable installation works at 110 kV or higher during the last 60 months, including design, installation of the cable and cable joints, and commissioning of the cable line; the contract value had to be at least EUR 1,000,000 excluding VAT. For the cable and joint manufacturer, the bidder must provide ISO 9001 and ISO 14001 certificates or equivalent, a list of previous works in the same voltage class, independent laboratory type-test reports, and a calculation of the cable’s rated current under the installation conditions described in the procurement. The bidder must also submit a technical description of the planned works, a completed team CV form, and a cable joint installer certificate.
