Compliance requirements
The tender documents include the standard exclusion grounds for criminal convictions, including participation in a criminal organisation, corruption, fraud and other mandatory grounds. The bidder or its management, administrative or supervisory body members, or authorised representatives must confirm whether any such ground applies and, if so, provide the required details. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where allowed by the procurement rules or the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the required compliance documents: the completed participation application form, the completed Annex 1 list of goods and unit prices, and the completed technical description form. For the offered medical device or products, the bidder must provide manufacturer-issued technical documentation in Estonian or English, such as information sheets, safety data sheets, registration certificates or certificates of compliance with EN standards, proving that the product meets the tender requirements. For each offered product, the bidder must provide the manufacturer’s declaration of conformity, instructions for use and, where applicable, an EC certificate of conformity. If equivalence is relied upon, it must be explained and supporting evidence must be attached. The tender must comply with all tender document requirements and conditional tenders are not allowed. In the case of a joint tender, a power of attorney from the joint bidders must be attached. The bidder must also confirm that, in performing the contract, subcontractors or suppliers representing more than 10% of the contract value are not Russian citizens, residents or entities established in the Russian Federation, or persons controlled by them, and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. The contracting authority also grants extra points if the company has a publicly accessible goal to reduce the climate or environmental impact of its activities.
