Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The bidder must confirm that neither the bidder nor the persons who may represent, decide for, or control the bidder have been convicted for the listed offences, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing. The bidder must also confirm the absence of tax, environmental charge, social security or similar payment arrears, and that the contract would not breach international or government sanctions. If a foreign company is involved, supporting documents on the absence of exclusion grounds must be provided for that company and its relevant representatives when requested.
