Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including no bankruptcy or liquidation, no tax or social security debt, and no related-party conflict with the technical consultant advising the apartment building renovation. In a joint bid, each joint bidder is treated as a bidder and the checks apply to each of them. Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and indoor water supply or sewerage systems. For electrical works, the bidder must also have the relevant electrical works notice for installation of electrical installations. Foreign bidders may prove equivalent competence with an equivalent document. The bidder’s net turnover for the financial year before the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, this condition may be met by one participant alone; turnover cannot be aggregated. The bidder must be able to provide a performance security equal to 5% of the contract value by the contract date or within 10 calendar days after signing. A deposit to the beneficiary’s bank account or notary account is also accepted if the beneficiary remains the entitled party throughout the construction period. Within the last 60 months before the start of the procurement procedure, the bidder must have completed at least one equivalent construction project as main contractor, with a value of at least half of the estimated contract value excluding VAT. The equivalent project must have involved building erection, extension and/or full-building reconstruction, and must have included at least load-bearing and external envelope works, forced ventilation with heat recovery, and heating system works. The bidder must provide the project name, building details, execution time, value, whether it was carried out as main contractor, and evidence such as the building register completion notice/permit number or a handover-acceptance report. The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction or level 6 construction manager qualification specialising in general construction; an object manager with at least level 5 construction work manager qualification specialising in general construction works; a ventilation and heating systems specialist with at least level 6 HVAC engineer competence or level 6 construction manager qualification specialising in indoor climate systems; a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer competence or level 6 construction manager qualification specialising in indoor or adjacent water supply and sewerage systems; and, for electrical works, a person with at least a B-class competence certificate or level 6 electrical engineer qualification for consumer electrical installations. Foreign bidders may use equivalent competence documents. The named persons must be involved in carrying out the works. The bidder must also accept the tender conditions, submit the offer on the required offer form, provide a power of attorney if the offer is signed by an authorised representative, disclose any trade secret information, confirm equivalence where relevant, and provide written consent from any team members who are not the bidder’s employees.
