Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. If evidence is available electronically, the relevant URL or reference must be provided. The machine-readable notice listed the exclusion grounds in the ESPD; the exact details should be checked in the tender documents if needed.
Qualification criteria and exclusion grounds
The bidder must have provided at least one catering services contract within the 36 months before the start of the procurement, with a value of at least EUR 130,000 excluding VAT. A list of completed contracts must be submitted, including a short description of the subject matter, the contract period, the total amount, the value of the catering services provided, and the details of the other contracting party. If requested by the contracting authority, the bidder must also provide the client’s confirmation or additional explanations, data or documents within five working days. If the bidder relies on the resources of other undertakings, it must also submit an ESPD for those entities and a confirmation that the resources are available and may be used. The bid must comply with the tender documents, include the required documents, and be properly prepared. In the case of a joint bid, a power of attorney must be submitted and the share and nature of each joint bidder’s performance must be stated. As a condition for submitting the bid, the bidder must inspect the place of performance. By the time the contract is signed, the bidder must have a valid food handling operating licence or obtain one by then. The bidder must submit a two-week sample menu for the school lunch of the lower age group and a written waste-prevention procedure. The bidder must also obtain the catering eco-label at least at the first level when the contract is signed, meaning that more than 20% of the ingredients are organic.
