Compliance requirements
The bidder must confirm that neither it nor its management body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, child labour, human trafficking, or any other exclusion ground listed in the notice. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice listed the exclusion grounds, but any more detailed conditions should be checked in the tender documents if needed.
Qualification criteria and exclusion grounds
In a joint bid, the bidders must submit a power of attorney for the joint representative and a statement of joint and several liability in the form of Annex 4, Form I. The bid must include the declaration in Annex 4, Form II. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. The bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are linked to the Russian Federation in the manner described in the notice. The bidder must be the official representative of the offered device and must provide a document proving the representation right granted by the manufacturer or, where applicable, by the manufacturer’s authorised representative. The offered device must bear the CE marking and comply with Regulation (EU) 2017/745; declarations of conformity and, where applicable, conformity certificates or copies must be submitted. The bid must comply with the technical requirements in Annex 1, and the bidder must provide the manufacturer’s technical data sheet and/or user manual as well as a maintenance plan for the warranty period. The bid price must be submitted in the required structure. If the tender documents contain any further compliance or qualification requirements, they must be checked in the official documents.
