Compliance requirements
The machine-readable notice included the standard exclusion grounds for criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder or its management, administrative or supervisory body members, or authorised representatives must not have a final conviction within the last five years, unless the exclusion period has expired. If an exclusion ground applies, the bidder may have to provide evidence of self-cleaning, where allowed by the procurement documents or law.
Qualification criteria and exclusion grounds
The bidder must have successfully completed at least one gravity sewer or stormwater pipeline construction project on an asphalt-paved street within the last 72 months. The project must have included at least 100 m of pipe with an internal diameter of at least ID500 mm, and the total installed pipeline length must have been at least 500 m. To prove this, the bidder must submit a description of the previous work showing the project name and location, client details, the time of performance, and confirmation that the work was carried out properly and in accordance with good construction practice. The bidder’s total net turnover for the last three financial years ended by the start of the procurement must be at least EUR 1,000,000. The contracting authority may request extracts from the last three annual accounts or other documents proving the turnover. The tender must comply with the procurement documents and, where necessary, an equivalence explanation and supporting evidence must be included. The bid must also confirm the existence of the bid security, the bid validity period is 3 months, and alternative or partial bids are not allowed. In a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also confirm that no subcontractor excluded under Section 122(7) of the Public Procurement Act will be used in contract performance.
