Compliance requirements

The bidder must confirm that neither it nor the members of its management, governing or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority may also reject the tender if more than 10% of the contract performance would involve subcontractors or suppliers who are citizens of the Russian Federation, entities established in Russia, or persons/entities owned or controlled by them or acting on their instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. In the case of a joint tender, an authorised representative must be appointed and a power of attorney plus a statement of joint and several liability must be submitted for the joint bidders.

Qualification criteria and exclusion grounds

The bidder must have, employed or otherwise engaged on a contractual basis, a technical specialist who has received technical training in the installation of the offered products. For lot 4, copies of certificates proving the technical specialist’s training and competence must be submitted with the tender. The bidder must provide the technical specialist’s details, qualifications and experience in the ESPD. The tender must comply with the requirements set out in the procurement documents, and where necessary equivalent solutions must be explained and supported by evidence. If any other qualification or compliance requirement was not fully visible in the machine-readable notice, it must be checked in the tender documents.
