Compliance requirements
The exclusion grounds are set out in the ESPD and cover the usual criminal conviction grounds, such as participation in a criminal organisation, corruption, fraud, money laundering, terrorism-related offences, child labour and human trafficking, as well as other exclusion grounds listed in the Public Procurement Act. The bidder must also confirm that no sanctions-related or other statutory prohibitions apply. If an exclusion ground exists, the bidder may submit evidence of self-cleaning, where permitted. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capacity: the successful bidder must have properly performed at least 2 similar contracts in the 3 years preceding the start of the procurement, where a similar contract means a euro area circulating coin minting contract worth at least EUR 150,000. The bidder must provide contract descriptions, total amounts, periods, clients and contact details. The minting company must have a valid ISO 9001 or equivalent quality management system and an ISO 14001 or equivalent environmental management system. In addition, a valid copy of compliance with the QMSC (Quality Management System for Euro Coins) requirements and the European Central Bank audit must be submitted. The compliance conditions require confirmation that the tender complies with the procurement documents, that the tender is unconditional, that a power of attorney is attached in the case of a joint tender, that business secrets are identified and justified, that subcontractors and suppliers linked to the Russian Federation do not exceed 10% of the contract value, that the supplied goods are not subject to international sanctions, and that at least 75% renewable energy and/or electricity obtained through high-efficiency cogeneration is used in the minting process. For paper rolls, plywood and the coin card cardboard, an FSC®, PEFC or equivalent certificate must be provided if the material comes from sustainably managed forests or is recycled. The machine-readable notice did not include precise qualification or compliance requirements; they must be checked in the tender documents.
