Compliance requirements
The bidder must confirm that none of the exclusion grounds apply. These include criminal convictions of the bidder or its representatives, illegal employment of foreign workers, child labour or human trafficking offences, tax or social security debt, and situations where the contract would breach international or government sanctions. The notice also mentions possible exclusion for serious breaches of environmental, social or labour obligations, bankruptcy or liquidation, serious professional misconduct, local tax debt, anti-competitive conduct, conflicts of interest, serious breaches of previous contracts, false information, attempts to influence the contracting authority, tax offences, or lack of the right to submit a tender. The bidder must submit the required confirmation form, and if it relies on another entity’s resources, it must also provide the corresponding confirmation for that entity.
Qualification criteria and exclusion grounds
The bidder must have provided Estonian language teaching within formal education during 01.01.2023 until the publication date of the contract notice, or Estonian language group training totalling at least 200 contact hours during the same period. The bidder must submit the prescribed qualification data form and indicate whether it relies on another entity’s resources for meeting the qualification requirement. All trainers must have either higher education in Estonian philology, the qualification of an Estonian language teacher obtained at an institution that can award higher education, or higher education plus at least 30 hours of Estonian language teacher courses as continuing training. They must also have agreed to participate in contract performance if the bid is successful and confirmed that they have reviewed and accept the tender conditions. The bidder must provide the trainers’ names, copies of documents proving their education, and, where applicable, copies of certificates proving completion of the teacher course. If the bid is a joint bid, a joint power of attorney must be attached. The training location must be at the place specified in the tender documents and within a 10-minute walk from an official public transport stop. The training curriculum must include the information required by the contracting authority in line with the continuing education standard and the objectives and learning outcomes set in the tender documents. The bidder must also confirm that the bid complies with the tender documents and, where relevant, explain equivalence and attach proof of equivalence. The bidder must identify any business secrets in the bid and justify why the information is confidential.
