Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy or liquidation, tax or social security debt, and the other grounds specified in the tender documents. The bidder must also confirm that its average wage during the reference period was above 70% of the average wage in the relevant sector and, if requested, provide proof from the tax authority or an equivalent foreign authority. The bidder must confirm that it is not a related party to the technical consultant advising on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and building or building-related water supply or sewerage systems. For electrical works, the bidder must have a registration for electrical works covering construction and installation of electrical installations; an equivalent proof is accepted for a foreign bidder. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In addition, the bidder must be able to provide a performance bond worth 5% of the contract value by the contract date or within 10 calendar days after signing; a deposit of the corresponding amount to the beneficiary’s or a notary’s account is also accepted if the beneficiary remains the entitled party throughout the construction period. Within the previous 60 months, the bidder must have completed at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value excluding VAT. The equivalent project must involve erection, extension or full-building reconstruction and must include at least construction or reconstruction of the load-bearing structure and external envelope, construction or reconstruction of a heat-recovery mechanical ventilation system, or construction or reconstruction of a new heating system. The bidder must provide the project name, timing, value, and proof through a commissioning notice, occupancy permit, or handover certificate. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. The project manager must hold at least a level 6 construction engineer qualification with a specialization in building construction or a level 6 construction manager qualification with a specialization in general construction. The site manager must hold at least a level 5 construction work manager qualification with a specialization in general construction works. The ventilation and heating systems specialist must hold at least a level 6 heating, ventilation and cooling engineer qualification with the relevant management competencies or a level 6 construction manager qualification with a specialization in indoor climate systems. The water supply and sewerage systems specialist must hold at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialization. The person involved in electrical works must hold at least a category B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. An equivalent qualification is accepted for a foreign bidder. The bidder must have a quality management system in the construction field meeting EVS-EN ISO 9001 and an environmental management system meeting EVS-EN ISO 14001, or equivalent conditions.
