Compliance requirements

The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption, fraud and other listed grounds. If an exclusion ground applies, the bidder may be allowed to demonstrate self-cleaning where the tender documents and applicable law permit it. The notice also requires confirmation that the bidder and relevant persons have not been convicted within the relevant periods and that any required evidence can be provided.

Qualification criteria and exclusion grounds

The bidder must have properly performed at least 3 contracts in the 48 months before the contract notice was published, where the subject was the supply, installation and operational commissioning of CAT II instrument landing systems (ILS) in civil aviation. At least one of those contracts must concern an ILS installation used in cold-climate conditions comparable to Tallinn Airport, meaning at an airfield located at latitude 54°00′ N or further north, or in other demonstrably comparable cold-climate operating conditions. For each contract, the bidder must provide the client’s name and contact details, an exact description of the contract subject, the completion deadline, the delivered equipment and its commissioning date, and confirmation that the system was accepted and put into operational use. If requested, a confirmation from the other contracting party that the contract was properly performed must also be provided. All equipment installed by the bidder must have been installed in Estonia, another EU Member State, an EEA contracting state, or a country that has joined the WTO Government Procurement Agreement. If the bidder relies on the capacities of another company, the bidder must also provide that company’s details and its consent to the reliance, its participation in the relevant part of contract performance, and joint liability for that part. The contracting authority may request additional explanations, data or documents within 5 working days.
